Section 104 of the Highway Traffic Act seems quite clear—you’ve got to wear a helmet while riding a motorcycle.

But for Brampton’s Baljinder Singh Badesha, a ticket he was given in September 2005 for just such an offence was just unacceptable and yesterday in a courtroom his fighting began.

Interesting article indeed, but this can open a whole lot of cans of worms.

Can of worms: I’ll bite.

design a helmet that fits. The law doesn’t say that you can’t ride a bike because of religious beliefs. It doesn’t say that you have to remove your religious head gear. It says that a helmet is mandatory. So… solution is to build an appropriate helmet. Sounds like a simple solution to me.

My brother rides a bike and the helmet discussion is brought up frequently. My sister-in-law says that the only use of a helmet is to keep you alive enough to know that you are in serious condition.
My thoughts are that the helmet (although does save lots of lives including a high school friend of my brothers – thank goodness that he was wearing a helmet) is more for the poor professionals who have to scrape the brains up off the road because of a biking accident. The helmet keeps things intact.

Actually, the intended reasoning behind helmet laws are for those riders who aren’t insured and become wards of the State when they become injured after an accident. It can cost quite a lot of money to keep someone alive after dashing their brains out…

Debbie…I concur ! If someone can’t stick to the law, and expect the law to be changed, then don’t bother getting on a bike.

we are a multi-cultural society (not a melting pot where we all take on the same cultural image). We, in my opinion, should be proud of our heritage and our society’s make-up. Embrace it. (especially since we, here in Canada, all come from another land at some point in our past).

some laws can probably be changed to reflect our population.
some laws SHOULD be changed to reflect our population.
and some laws should be changed because they are not “right”.
But to remove a safety law because it doesn’t fit rather than trying to figure out how we can work with the law seems a bit closed-minded.

Working with young children it is my goal to help them develop back-up plans to work within limitations but still reach their intentions (when appropriate).

Think people think… how can we work together to overcome the challenge. Not much of Mother Nature’s world is simply black and white. Life isn’t black & white. Thinking shouldn’t be black & white.

This is vaguely politcal in nature.

With the exception of the indigenous native population, yes we are all immigrants at some point.

We can thank Trudeau for this policy of a multi cultural society….......and I dont have to agree with it. I have so many friends who had to pay tens of thousands of dollars to get to Canada. Most speak three or more languages fluently and all of them speak “English”. All are very skilled. None have ever collected welfare or UIC. Some, have been sent back to their native land for some “error” in paper work. Some I do not know move into a condo, then have their children and grandchildren move into the same condo, then cook and watch the property value of (said neighbors condo where Mr and Mrs retired live) the condos that surround them drop like a stone. It all becomes a matter of perspective.

As a boy, my father sponsered many immigrant families by giving them jobs and a roof over their heads. There was many a month where I had to give up my bedroom and sleep in the basement to make room for a young family. As a boy, my father went beyond the Berlin wall to bring relatives back to the land of the free.

I have no issue with immigrants coming here. none what so ever. I would prefer that those who do come make somekind of effort to at least learn one of our two official languages. before I go much further, this multi cultural society to which we “think” we live in…...go acroos the pond and check out Serbia, Check out Darfur, the Congo, Kenya, to name a few….........from my perspective it doesnt seem to work and their countries are much older then ours. The European Union is working and I can assure you, that all those who belong share the same values. It’s direction would appear to be heading (albeit slowly) into a singular cultural direction.

I have never been one to judge people by their hair, their colour, thier creed but it irks me when I drive to Markham and all the street signs are in some foriegn language. This is CANADA…..not CHINA. It’s CANADA, not INDIA. We have this constant push to have Jewish courts, Islamic courts, always seems to me that the rights of the minorities supercede the rights of the majority. This is a democracy, where the majority wins, not the minority.

I am always curious about politics. Finger waving and racist remarks. Take for example “Palistine” and the “occupied Territories”. I am curious as to whether Syria, had they won the six day war…....would they have granted the Palistininas their own country, they sure want Isreal to do what they wouldnt. I’m not trying to play favorites but near as I can figure, theres a lot of money in Arab nations….........why dont they offer some $$$$$ to building Palistine, to their hospitals and schools?..........I digress

Do you think, that if you you immigrated to Iran that they would let you speak your native tongue, that you could remover your Burka. ...............how about Saudi Arabia?......How about Pakistan? All countries I would love to see.

People come to this country because we have an excellent health care system, an excellent educational system, an excellent infrastructure, and we are tolerant. We dont blow our horns claiming to the world how great we are. We are, for the most part, a polite bunch. People will risk their lives to get here. People will spend tens of thousands of dollars to get here. People come here, say good bye to friends and family from their home country knowing that they might never see them again which to me, means that what they left must be pretty rotten…............why, do they want to turn Canada, into what they left behind?

The day that religion/church was seperated from state was the day the human mind expanded exponentially. We have conquered flight, space, desease, plagues. The earth is no longer flat, we quit burning witches at the stake. As far as I am concerned we should have one set of laws for every one. It is for the politicians to change that the laws that are unjust. We should have one eductaional system for every one.

Religion doesnt belong in the state, the schools or the courts….........period.

If you dont want to wear a helmet…...............buy a car…... Knives in school because of religous beliefs?

For some reason it bothers me when I ask a person in Canada, who they are and they answer…...”I’m Chinese” or “I’m Indian” or “I’m German”

What ever happened to….........”I’m Canadian”

To think that our men and women are over seas risking thier lives and dying for peoples rights to remain “disrespectful”......for freedom

Well,
I am French Canadian born!
My great-grand father, my grandfather, my father,2 uncles (one dead in Holland) 3 of my brothers and one nephew are or were part of this great Canadian army and went (are) overseas!!
I am bilingual! I have lived in 4 provinces!
In all of them I was told that I did not belong “here”!
But, I am Canadian. My family has paid the price so we can be proud to say so.

So, if we cannot accept our own, who have been here since the beginning, and allow them to say that they are Canadian no matter their background, how can we expect “others” to say that they are Canadian. There will always be people to tell them to go back where they come from. As I was told!!

So, let’s get away from this topic, believe me, it will not change anything. Might just hurt some feelings!!!

BEEN THERE!!!

We do not make it that easy for “others” to say that they are Canadian!

Greenthumb…..I hear ya, and the first 2 lines in your last post above says it all really! I know people like to go on about the length of time they or their ancestors have been here, but at the end of the day, line 2 of your post applies to all of us.

I am Polish by birth and I have been living in Canada since 1999. I used to live in the US prior – 10 years. I still consider myself Polish and I always will even though I don’t like Poland or Poles too much. National identification is something that cannot be erased ever. If you’re born in country X, learn language X, absorb everything that is X in your growing years then you cannot mentaly become Y by virtue of moving to Y. And not because you don’t want to but because you carry your permanent mental imprint of belonging to X. Having had said that there is still of matter of identification within Y. I’d love to say ” I’m Canadian” but it is not true. Regardless my estrangement from Poland I’m still not Canadian. For me to be a Canadian is not only to obey the laws but also to experience almost metaphysical identification with my host country. Which is increasingly difficult as according to recent polls every 2nd person in Toronto is foreign born.
I’ve been to and lived in many countries and my motto has always been to observe and adapt. I am strongly opposed to newcomers trying to introduce their own agenda – religious mostly – and force the majority to observe it. For me multiculturalism is acceptance of a foreigner and welcoming him/her to the neighborhood along with expectation to act withing approved norms and laws.
I wonder if all of you had a chance to read a former premier of Australia famous statement?
“IMMIGRANTS, NOT AUSTRALIANS, MUST ADAPT. Take It Or Leave It. I am tired of this nation worrying about whether we are offending some individual or their culture. Since the terrorist attacks on Bali, we have experienced a surge in patriotism by the majority of Australians. This culture has been developed over two centuries of struggles, trials and victories by millions of men and women who have sought freedom. We speak mainly ENGLISH, not Spanish, Lebanese, Arabic, Chinese, Japanese, Russian, or any other language. Therefore, if you wish to become part of our society, learn the language! Most Australians believe in God. This is not some Christian, right wing, political push, but a fact, because Christian men and women, on Christian principles, founded this nation, and this is clearly documented. It is certainly appropriate to display it on the walls of our school s. If God offends you, then I suggest you consider another part of the world as your new home, not Australia.”
And it about sums up what I feel. Including the infamous helmet law.

Wow….Just reading those words again from the former Premier, really makes you think hard. I might not condone everything that was said there, but there were some damn good points in the whole statement.

Fighting words for sure.

Religious beliefs and culture issues, always seems to come from a certain section of the society here in Canada. I think people forget that, being a guest in someone’s home, you don’t get to dictate how you want things done!

Nobody has to ride a motorcycle.

I’m not really fond of my rights being trampled either.
Could the sihk religious leaders come forward and endorse a treatment policy for their injured members who cannot comply normally to the existing regulation?

I would hate to think that these individuals were deliberately exposing me to a life time of medical and social welfare bills should they receive a head injury by flouting a law designed to protect them.

See, now I am really tolerant after all.

My pockets just aren’t as deep as some would like.

I want to add that my feelings extend to all nut cases that take on high risk life styles and expect me and others to pick up their mistakes. ( skiers , surfers, skydivers,and macho sailors come to mind)

There were a couple of fools early this week that got ejected from their vans because they weren’t wearing seat belts when the van they were travelling rolled over.

There is talk of making people who choose to do this, pay their own hospital bill. I am all for it to be honest! It’s just plain laziness really and it’s got to be right up there with people that can’t be bothered to signal when making lane changes.

I’m a pretty good swimmer and I like to canoe. So I usually don’t bother with a life vest on slow water. It is against the law in my country. You can ride in a speed boat without a life vest, but in a non-motorized you need a vest. We also do not have helmet laws for motor bikes, but you will get a ticket for no seat belt in your car. A child can drive an ATV, jet ski, or snow mobile. I can drive around with a shot gun in my back window, but not carry a 3” pocket knife in my pocket. If I’m late with a quarterly government report I’m fined and treated like a criminal. I don’t have any answers or solutions. Most days I just do the best I can. I don’t even know “the rules of the land” half the time. I think I’ll go disturb earth worms.

The other joke of is that we as taxpayers in Canada are paying for this lawsuit. We are paying for his lawyers.

His lawyer was asked that during an interview on a talk radio show and he admitted as much. I agree if you want to ride a bike and their is a helmet law make one that fits. At my work I had to get a helemt made because my head is more oblong than round and it did add a cost of about $300.00 but that point is it can be done.

But I get the feeling this is a fight just to fight. To see how far one can push the system. There is no discrimination just lack of compliance to a law. And I would be willing to bet that if there was a helmet law right accross North America this would not be a issue.

The funniest thing is, if it this had happened in the country the biker originated from, and there was a law saying you HAD to wear an helmet, and he didn’t, he would have had the living crap beaten out of him without the matter even going to court.

Not that I condone this behaviour, but people have to appreciate what they have, knowing that they couldn’t pull the same stunt in their country of origin. The way he was enjoying the attention after coming out of court is what really got on my nerves
